Hess Elite Performance & Longevity (“Hess Elite,” “the platform”) provides strength and conditioning coaching, movement assessment, Muscle Activation Techniques (MAT) services, and related fitness programming. Hess Elite is a coaching and training business. It is not a medical practice, and no service delivered directly by Hess Elite, its coaches, or its staff constitutes the practice of medicine.

Any medical care referenced on this platform, including but not limited to laboratory testing, hormone replacement therapy, GLP-1 protocols, peptide therapy, and other prescription-based interventions, is provided exclusively by an independent medical practice affiliated with Hess Elite. That practice operates independently of Hess Elite's coaching operations, maintains its own clinical records, and is solely responsible for all diagnostic and treatment decisions made within its scope of practice.

Enrollment in any Hess Elite coaching tier does not itself enroll a client in medical care, and enrollment in the affiliated medical practice's services does not alter the coaching relationship. The two relationships are contractually and operationally distinct, and a client may hold one without the other.

Coaches, trainers, and MAT practitioners engaged through Hess Elite are fitness professionals. None holds a medical license issued by the State of Colorado or any other jurisdiction, and no interaction between a client and a Hess Elite coach or trainer, whether in person, remote, by video, by messaging, or through the platform's application, creates a doctor-patient relationship, a therapist-client relationship, or any other clinical relationship.

Coaches and trainers do not diagnose medical conditions, interpret laboratory or imaging results as clinical findings, recommend or adjust medication, or provide treatment for injury, illness, or disease. Guidance a coach provides regarding movement, exercise selection, load, or recovery is fitness guidance, not medical advice, and should not be treated as a substitute for evaluation by a qualified medical professional.

Where a client's stated goals or intake information suggest that a higher level of medical evaluation is appropriate, Hess Elite refers the client to the affiliated medical practice described in the following clause. Only a licensed physician within that practice, after an independent clinical evaluation, establishes a doctor-patient relationship with the client.

Hormone replacement therapy, GLP-1 protocols, peptide therapy, and any other prescription therapeutic referenced, described, or offered as an add-on anywhere on this platform is prescribed exclusively by licensed medical providers practicing within Hess Elite's affiliated medical practice. Prescribing decisions follow an independent clinical evaluation, including any laboratory work the prescribing provider requires, and are made solely at that provider's professional judgment.

Prescriptions issued by the affiliated medical practice are filled exclusively by licensed pharmacies. Hess Elite does not stock, dispense, sell, or administer any prescription medication, and no coach, trainer, or non-prescribing staff member is authorized to provide instructions regarding dosing, administration, or discontinuation of any prescription therapeutic.

Nothing on this platform, including tier descriptions, marketing copy, or intake form language referencing HRT, GLP-1s, or peptide therapy, constitutes a prescription, a medical recommendation, or a guarantee that any individual will be found to be an appropriate candidate for a given therapeutic following clinical evaluation. Candidacy is determined solely by the prescribing provider.

Results from strength and conditioning coaching, MAT sessions, remote programming, or any affiliated medical protocol vary by individual and depend on factors outside Hess Elite's control, including genetics, baseline health, adherence to programming, nutrition, sleep, and prior injury history. No specific outcome regarding strength, body composition, athletic performance, joint function, or longevity biomarkers is promised, warranted, or guaranteed.

Any case example, testimonial, or before-and-after reference used on this platform reflects an individual result and is not represented as typical or guaranteed for any other client. Coaching recommendations are professional opinions based on the information available at the time given, not assurances of future outcomes.

Physical training, movement assessment, and MAT-based intervention carry an inherent risk of injury, including but not limited to musculoskeletal strain, sprain, and aggravation of pre-existing conditions. Clients are strongly encouraged to consult a qualified medical professional before beginning any new exercise program, particularly where prior injury, surgery, or a diagnosed medical condition is present, and to disclose relevant medical history to their coach and, where applicable, to the affiliated medical practice.

Participation in Hess Elite coaching, whether in person or remote, is voluntary. By participating, the client acknowledges and assumes the risks described above and agrees that Hess Elite, its coaches, and its affiliated medical practice are not liable for injury arising from participation, except where such liability cannot be limited or waived under Colorado law.

This disclaimer, and any dispute arising from or relating to use of this platform or the coaching services described on it, is governed by the laws of the State of Colorado, without regard to its conflict-of-law principles.

Any legal action or proceeding arising out of or related to this disclaimer or the platform shall be brought exclusively in the state or federal courts located in Denver County, Colorado, and each party consents to the personal jurisdiction of those courts.
